Where a second opinion is unavailable within the 24 hour timeframes specified for a voluntary conversion to involuntary status can completion be legally valid in any circumstances if achieved outside the hours specified and what is the advice in managing such cases from the Act point of view where the time frames are not met.
Answer:
A person can be detained for a 24 hour period if in the opinion of a registered medical practitioner, registered nurse or a consultant psychiatrist that this person is suffering from a mental disorder. The purpose of this detention is for an examination by another consultant psychiatrist to determine the presence of a mental disorder. There are no legal provisions to detain that person any longer than 24 hours.
