Question:
When the HSE goes to court to apply for the detention of a child in an Approved Centre will the parents/guardians of the child have the right to free legal representation?

Answer:
There is no provision in the Mental Health Act, 2001 to provide legal representation to the parents of a child who is the subject of an application to a District Court for an involuntary admission to an approved centre.
